FMV´s processing of personal data

What is processing of personal data?

Personal data is all information that can be used for identifying a single physical person. Examples of personal data are name, national identification number, photography, physical address and email address. Processing means any operation performed upon personal data, such as collection, recording, structuring, storage or disclosure of data.

FMV, as controller, is responsible for processing personal data on this website and for handling of personal data in our operation.

The General Data Protection Regulation

EU´s General Data Protection Regulation regulates how personal data are processed. As a controller, FMV ensures that your, as well as other people´s, personal data are protected and processed according to relevant laws and FMV´s internal guidelines and policies. FMV also has a Data Protection Officer assigned with the task to review that FMV fulfills all requirements in the regulation.

FMV´s processing of personal data

The legal basis for handling personal data are found in article 6 in the General Data Protection Regulation. The most common basis for FMV´s processing of personal data is that it is necessary for:

  • The performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract (article 6.1 b)
  • Compliance with a legal obligation to which FMV is subject (article 6.1 c)
  • The performance of a task carried out in the public interest or in the exercise of FMV´s official authority (article 6.1 e)

Based on this FMV is e.g. entitled to process personal data necessary to comply with a requirement in a law or ordinance or to fulfill an assignment from the Riksdag or government.

FMV is a public authority. Messages sent to FMV, as a rule, will become registered public documents and are upon request disclosed, unless protected by secrecy. As a public authority FMV has to observe archive regulations regarding preserving public documents. Personal data that is part of public documents will therefore be handled in accordance with this.

FMV is a procurement authority. Personal data is processed in order to administrate customer- and supplier relations and can be submitted and collected before- and in conjunction with signing an agreement and initiating orders or on other occasions connected to a customer- and supplier relations.

Personal data is also processed when a third party

  • contacts FMV to obtain information or public documents
  • is involved in a recruitment process
  • is signing up for attending educational programs or events
  • requests access to any of FMV´s protected areas or premises
  • is using a subscription service, or
  • is contacting FMV for other reasons.

On some occasions, FMV uses external IT-service providers and other personal data processors that can have access to the authority´s IT-systems. Suppliers and others handling personal data for FMV are always required to sign a personal data processing agreement regulating how the data is used.

FMV is sometimes required to share personal data with other government authorities, for example to the Swedish Security Service during a recruitment process or to juridical courts during contract appeals.

Rights of the data subject

Registered data sharing

All individuals have the right to, without any cost, require access to stored personal data by receiving a registry print out. Any requests for registry print outs shall be submitted to FMV.

Rectification and erasement

All individuals can require having personal data rectified or erased if they are inaccurate or insufficient. On some occasions, it is possible to object to the processing of personal data or request for constraints in the use of personal data. Because of the obligation to preserve public documents, FMV has limited ability to erase data.

Withdrawal of consent

If the processing of personal data is based on consent, the person who has given consent has the right to, at any time, withdraw the consent. The withdrawal does not affect the legality of the handling of personal data performed under the consent before its withdrawal.
